These Terms of Use ("Terms") govern your access to and use of morristownbraces.com (the "Website"), operated by Morristown Braces ("we," "us," or "our"). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

These Terms cover use of the Website only. The relationship between Morristown Braces and our patients is governed by separate consent forms, treatment agreements, financial agreements, and our Notice of Privacy Practices, which are provided in person at the start of care.

1. The Website is informational, not medical advice

Content on the Website — including service descriptions, blog posts, FAQs, and resources — is provided for general informational purposes only. It is not medical, dental, or orthodontic advice and does not create a doctor-patient relationship.

  • Do not rely on Website content to diagnose or treat any condition.
  • Always consult a qualified healthcare provider for personal medical advice.
  • If you have a dental emergency, call us at (973) 998-6266 or seek immediate care.

A doctor-patient relationship between you and Morristown Braces is established only after an in-person consultation, agreement to a treatment plan, and execution of the appropriate consent forms.

2. Eligibility

You may use the Website if you are at least 18 years old or have the consent of a parent or legal guardian. By using the Website, you represent that:

  • You meet the age requirement.
  • The information you submit through forms is accurate and your own (or that you are authorized to submit it on behalf of a minor or another person).
  • You are not prohibited from using the Website under U.S. law.

3. Account-free use

The Website does not require an account. We do not currently offer a patient portal through the Website. Forms and booking widgets may collect information and route it to us through HIPAA-compliant systems; that information is governed by our Privacy Policy.

4. Acceptable use

When you use the Website, you agree not to:

  • Violate any law, regulation, or third-party right.
  • Submit false, misleading, or fraudulent information through any form.
  • Impersonate another person or misrepresent your relationship to a patient.
  • Attempt to interfere with the Website's operation, including by uploading malware, probing for vulnerabilities, or overwhelming our servers.
  • Scrape, harvest, or extract data from the Website by automated means without our written permission.
  • Reverse engineer, decompile, or attempt to extract source code from the Website.
  • Use the Website to harass, threaten, or defame any person.
  • Reproduce, distribute, modify, publicly display, or create derivative works from Website content except as permitted in Section 5.

We may suspend or terminate your access if you violate these Terms.

5. Intellectual property

All content on the Website — including text, images, logos, photography, graphics, design elements, blog posts, and software — is owned by Morristown Braces or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may:

  • View and print Website content for your own personal, non-commercial use.
  • Share links to Website pages.

You may not, without our written permission:

  • Use Morristown Braces names, logos, or branding for any purpose other than identifying our practice in fair use contexts.
  • Republish or redistribute Website content (other than incidental quotation with attribution).
  • Use Website content for AI training, machine-learning datasets, or competitive analysis.
  • Frame, mirror, or otherwise reproduce the Website.

Patient photos, before/after imagery, and testimonials shown on the Website are used with consent of the patients (or their parents/legal guardians). They remain the property of Morristown Braces and may not be reused.

Trademarks of third parties (Invisalign, LightForce, Opalescence, KöR, CareCredit, and others) are the property of their respective owners and are used with permission or under fair use.

6. User-submitted content

If you submit information, photos, questions, reviews, or other materials to us through the Website ("Submissions"), you represent that:

  • You own or have the right to submit the content.
  • The content is not unlawful, harmful, infringing, or otherwise objectionable.

By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display the content in connection with operating the Website and our practice. This license does not extend to PHI you submit as a patient, which is governed by HIPAA and our Notice of Privacy Practices.

You can request removal of your Submission by emailing info@morristownbraces.com.

7. Third-party links and services

The Website includes links to third-party websites (e.g., manufacturer pages, social media, booking platforms, mapping services). We do not control those sites and are not responsible for their content, privacy practices, or terms. Use them at your own risk and review their policies before providing information.

8. No warranty

The Website is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Website will be error-free or uninterrupted.

We do not warrant that:

  • Information on the Website is current, complete, or accurate at all times.
  • The Website will be available without interruption.
  • Defects will be corrected, or that the Website is free of viruses or harmful components.

9. Limitation of liability

To the fullest extent permitted by law, Morristown Braces, Dr. Marina Gonchar, our team, and our affiliates and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Website — even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from your use of the Website will not exceed one hundred U.S. dollars ($100), regardless of the cause of action.

This Section does not limit liability that cannot be excluded under applicable law, including liability for personal injury caused by negligence, fraud, or any other liability that cannot be lawfully limited or excluded. Liability arising from clinical care is governed by separate agreements and applicable malpractice and professional-conduct laws, not by these Terms.

10. Indemnification

You agree to indemnify and hold harmless Morristown Braces, its owners, employees, contractors, and affiliates from any claim, damage, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Website.
  • Your violation of these Terms.
  • Your violation of any law or third-party right.

11. Privacy

Your use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to the Website and to these Terms

We may modify, suspend, or discontinue any part of the Website at any time without notice. We may also update these Terms. The "Effective Date" at the top reflects the latest version. Material changes will be posted on the Website. Continued use after a change constitutes acceptance.

If you do not agree to a change, your remedy is to stop using the Website.

13. Termination

We may suspend or terminate your access to the Website at any time, with or without notice, for any reason — including suspected violation of these Terms. Sections that by their nature should survive (intellectual property, no warranty, limitation of liability, indemnification, governing law, and dispute resolution) will survive termination.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles.

Any dispute arising from these Terms or your use of the Website will be resolved in the state or federal courts located in Morris County, New Jersey, and you consent to personal jurisdiction in those courts.

This Section does not apply to disputes regarding clinical care, which are governed by separate patient agreements and applicable healthcare law.

15. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and any patient-specific agreements, constitute the entire agreement between you and Morristown Braces regarding the Website.

Our failure to enforce any right or provision is not a waiver of that right or provision.
